Long-lease properties for sale

The City of Luxembourg is offering for sale a number of housing units (apartments and houses) that have been built as part of the City's housing development projects, or purchased as part of the implementation of the City's Special Development Plans (Plans d'Aménagement Particuliers – PAP).

To keep prices affordable, the City is selling the housing units only, with the land being provided under a long-lease agreement, subject to certain conditions. For the properties in question, the City is entitled to enforce its right of first refusal.

Allocation procedure

Prospective buyers must apply to join a waiting list. Applications must be submitted using the application form and will be assessed on a per-household basis. Applicant must ensure that their application details are kept up to date. Applications must be renewed within six months of the initial application.

The College of Aldermen regularly allocates available units.

The sale transaction will be formalised before a notary. The deed of sale will become binding once it has been approved by the Municipal Council and forwarded to the relevant minister.

Eligibility criteria and allocation rules

The housing units will be allocated based on

  • eligibility criteria:
    • the housing unit that the prospective buyer is applying for must be suited to the composition of their household;
    • the applicant's income must not exceed the ceilings set by the City;
  • allocation rules based on the main features of the applicant's socio-economic status.

No more than two natural persons (Applicant A and/or Applicant B) may submit an application to purchase a housing unit. All applications must specify the composition of the applicant's household.

Household

The term "household" means: The applicant(s) and all other natural persons living with them in the same accommodation and considered as a domestic unit with a common budget, and who are unable to provide material evidence that they live elsewhere.

Selected applicants will only be offered housing units that are suited to the composition of their household, with no more than one bedroom per adult, couple or child over the age of 12, or per two children under the age of 12, and with no more than one additional bedroom.

Net monthly income ceilings

All applicants must submit a "Certificate of eligibility for the purchase of affordable or low-cost housing" (Certificat d'éligibilité à l'acquisition d'un logement abordable ou d'un logement à coût modéré), issued by the Single Point of Contact for Housing Assistance (em>Guichet unique des aides au logement) at the Ministry of Housing (Ministère du Logement). The certificate must be for the household in question. A "negative" certificate will be required, even if the applicant does not meet all the eligibility criteria.

The net monthly income ceilings apply for housing units that have been built as part of the City's housing development projects, but which are outside the scope of the legislation on affordable housing.

f) Settling ties

In the case of a tie (same number of points), the housing unit will be allocated to the applicant(s) whose place of work is the closest.

If there is still a tie, the housing unit will be allocated to the applicant(s) whose household has the lowest income, as determined pursuant to Article 56 of the Law of 7 August 2023 on affordable housing (loi du 7 août 2023 relative au logement abordable), weighted by consumption unit (CU):

  • 1.0 CU for the first adult in the household;
  • 0.5 CUs for any other person over the age of 14;
  • 0.3 CUs for each child under the age of 14.

Emphyteutic right and right of first refusal

The land on which the housing unit is built will be provided by the City of Luxembourg as a 99-year long-lease holding in consideration of an annual fee of €498.55 (977.10 index points – 01/11/2023) for a house, €269.22 (977.10 index points – 01/11/2023) for an apartment, and €27.22 (977.10 index points – 01/11/2023) for a plot of land. These values are indexed on the sliding scale of wages.

The applicant(s) selected by the City will be the owner(s) of the buildings. The City of Luxembourg may enforce its right of first refusal at any time during the term of the emphyteutic lease. The conditions governing the transfer of the City's emphyteutic lease, as well as the prices that the City will pay to repurchase the housing units, are specified in the notarised deed.

The housing units in question must be the purchasers' main residence, and must not remain vacant or be rented out in whole or in part. These clauses are mandatory conditions in notarised deeds for the transfer of emphyteutic leases.

The City reserves the right to amend these allocation rules.
